Day 509

 I know that its been a week since I wrote my last blog. But seriously speaking, I wasn’t having any related topic to write on. I tried to concentrate on few topics but couldn’t got the content for those topics. Well, I tried to write something extempore but that also didn’t helped.

 

When the Nirbhaya case happened and the way in which the culprits were punished then I thought that at least a message will go in the public that rape culprits won’t be spared. But I was wrong. Similar incidence happened in Hyderabad also. The accused were arrested by the Hyderabad police. While investigation, all the accused tried to escape from police custody. We know that all the accused were killed in the encounter while the process of rearrest was going on. There was a lot of debate on this encounter. Many so called intellectuals and human right activist called this encounter as fake and they blamed the Hyderabad police for the killing. The same intellectuals and human right activist were silent when the news of inhuman torture of rape victim came out. I think the encounter was a part of the duty which the investigating team of Hyderabad police. I don’t think that encounter was fake and illegal.

 

I was wrong again when an R G Kar hospital incidence took place in Kolkata. This was the most inhuman torture and murder case I have heard after rape of the victim. I was surprised to know that Kolkata police took a lot of time to arrest the accused because the accused was member of the Trinamool Congress, the ruling party of the West Bengal. On records its said that the accused, Sanjay Roy, was a civic volunteer with Kolkata police disaster management force. The Station House Officer of the Tala police station under whose jurisdiction R G Kar hospital come, was detained and accused of tampering with evidence and misleading the investigation.

 

I wonder why a SHO will tamper with evidence and mislead the investigation. This generally happens when the accused is known to the SHO and had personal relationship with him. Second reason is that he might have got orders to do so from the higher office. There was no personal relation established between the accused and the SHO. Well, the accused was sentenced to life imprisonment.

 

Well, I don’t think that life imprisonment is suitable sentence for the rape culprits. I’m not going against any judgement. I’m simply putting my view. Life imprisonment means putting the culprit in jail for his entire life. But in case of R G Kar Hospital case, brutal murder followed the rape. The organs of the deceased were bulging out. This is a barbaric torture done by the accused. So, according to me, the accused should get death sentence. Nothing less than that won’t do the justice to the innocent intern who died that night. I hope that very soon the case will be put up in the Kolkata High Court.

 

I think we need some more rigid laws for the rape and murder cases. Once its proved that the accused is the real culprit of rape and murder then, I think death sentence is the only legal option left. For rape cases, solitary confinement should do the justice. Well, there are numerous cases of rape pending in the judiciary. These days, rape victims doesn’t want to lodge the complaint itself because of shame. They don’t want to have the mental pain again and again at police station or in the court. Its true that any case is registered at the lower court. First verdict comes from the lower court itself then only one of the parties can move to the High Court and then to the Supreme Court.

 

In my view, separate fast track courts should be formed for rape cases. Then the cases will be solved in lesser time and with smooth functioning of the judiciary system. Meanwhile, government should make strict laws for rape and murder. It should be made taking the Nirbhaya and the RG Kar Hospital cases in the consideration. Let's hope that no more incidences happens like those incidences where rape and murder was done in barbaric ways. Well, I think such incidences are result of sick mentality and it should be treated as the rare cases where the accused had crossed all the human limits. So, while delivering the sentence, there should not be any doubt in mind about lenient sentences.
